N. the name of the Holy Trinity, Father, Son and Holy Ghoft, three Perfons in one only true God, for his Glory and Service, and for the Advancement of his Kingdoms: Be it known to all who fhall fee this present Writing and Inftrument, containing the Contract and Treaty of Marriage which follows; That whereas in the City of Madrid, his moft Catholick Majesty's Court, in his Royal Palace, Wednesday the 20th of August, 1612. in prefence of the Illuftrious Don Anthony Cayetan, Archbishop of Capua, Legate a Latere to our Holy Father Pope Paul V. his Apoftolical Nuncio in his Kingdoms, in the name of his faid Holiness, and of the Lord Count Orfo Delzi, Ambaffador from the Great Duke of Tufcany for what is by him poffefs'd; and in the prefence of the Lords, the Dukes of Infantado and Albuquerque, the Marquifs of Caftel-Rodrigo and Villa-franca, all four Counfellors of State to his Catholick Majefty, of the Duke of Uzeda, Admiral of Caf tile, Prince of Tyngry; the Duke of Maqueda, the Duke of Pegnaranda, the Duke d' Alva, the Duke of Ceffa, the Duke of Feria, the Duke of Montalto, the Duke of Villa-Hermofa, the Duke of Veraguas; Don Juan of Idiaca, Great Commandant of Leon, of the Council of State of his faid Majefty, and Prefident of the Orders; Don Auguftin of Mezia, alfo of the Council of State; and Don Diego Lopez of Ayala, Licentiate, alfo of the Vol. II.

Council of State, and Great Chamberlain to his Majefty, and many other Lords and Knights: The most excellent Lord, Don Francis de Sandoval, of the Lineage of Rozes, Duke of Lerma, Marquifs of Denia, Grand Commandant of Caftile, of his Majefty's Council of State, his Butler, Master of Horfe, Governor and Great Steward of the moft High and Triumphant Prince of Spain, Captain-General of the Cavalry of Spain, appearing before me Antonio d' Areftegny, Knight of the Order of St. James, Secretary of State, Clerk and Notary to his Royal Catholick Majefty, in the name and as Procurator of the most High, moft Excellent and most Potent Prince, Don Philip the Third of that name, our Lord and Mafter, by the Grace of God King of Caftile, Leon, Arragon, both the Sicilies, Jerufalem, Portugal, Navarre, the East and West-Indies, and Duke of Milan, &c. by virtue of the Power which the faid Duke of Lerma has receiv'd from his Catholick Majefty, by a Brevit and Provifion fign'd with his Royal Hand, and counterfign'd by me the forefaid Royal Secretary, made and pafs'd at St. Laurence of the Efcurial, the 30th of July the faid year, as King, Father and lawful Adminiftrator to the most Serene Infanta his Daughter,. and of her Majefty Q. Margaret, his lawful Wife and Spouse, on the one part. And there appearing on the other part, the moft Excellent Henry of Lorain, Duke of Mayenne and Efquillon, Peer and Great Chamberlain of France; and with him, in order to affift him, do appear, and are perfonally prefent, the Sieur Viscount de Puifieux, Counsellor of State to his moft Chriftian Majefty, Se cretary of his Orders and Finances, Great Treafurer of his Orders, and his Ambaffador Extraordinary on the other part, for that very purpofe, at the Court of his Catholick Majefty; and the Baron of Vaucelas, Counfellor of State to his faid moft Chriftian Majefty; for and in the name of the moft High, moft Excellent, and moft Potent Prince Lewis XIII. by the Grace of God, the moft Chriftian King of France and Navarre, and the molt High, moft Excellent and moft Potent Lady Mary, the moft Chriftian Queen of France and Navarre, his Mother, Tutrix and Regent in his Kingdoms; by virtue of the Powers which they have exhibited and reprefented, written originally in French, fign'd with their

Royal Hands, and feal'd with their Royal Seals, given and granted in their Royal City of Paris that is to fay, that of the most Christian King, the 17th of July this prefent year, and that of the faid moft Chriftian Queen, the 19th of the faid month and year. The Originals of which Powers of the abovefaid, are in the keeping of me prefent Secretary of State, to be inferted at the end of this prefent Writing. The faid Duke of Lerma, in the name of his Catholick Majefty, and the faid Lords, the Duke of Mayenne, Viscount of Puifieux, and Baron of Vaucelas, in the name of their Majefties, as most Christian and Catholick Kings, in which the Interest of their Kingdoms is concern'd, and in order to fecure the Peace of their Crowns and of all Christendom, which has been obferv'd ever fince it was concluded and fettled between the Catholick Majefty of the late King, Don Philip II. our Mafter, and his late moft Chriftian Majefty Henry IV. Fathers to their moft Chriftian and Catholick Majefties, reigning at this prefent; and defiring that it may be perpetual, not only during the Life of their Majefties, but alfo during that of their Defcendants and Succeffors, they could not think of any more fit and proper method than that of Marriages, or any more efficacious means than accomplishing double and reinforc'd Ties of Relation. Thro the Grace of God, to the Increase of his Divine Service, and with the Benediction of our moft Holy Father Pope Paul V. and the Mediation of the Great Duke of Tuscany, The Efpoufals and Marriages of the most Serene Prince of Spain, Dan Philip, with the most Serene Ifabella, Sifter and eldest Daughter to their most Chriftian Majesties, as alfo of the most Chriftian King Lewis XIII. with the most Serene Infanta, Lady Anne, eldest Daughter to his Catholick Majefty, are already treated and agreed: that fo by those new Ties they may be more ftrictly ally'd, and the Love, Amity and Brotherhood more confirm'd, that is, and is defir'd to be preferv'd betwixt their Majefties. And that they may have their full and entire Effect, the forefaid Lords Commiffioners, in the abovefaid Names, in what concerns the Marriage of the moft Chriftian King with the most Serene Infanta, Lady Anne, have capitulated and confented to what follows.

That

That with the Grace and Benediction of God first of all obtain'd, and the Difpenfation of his Holiness, becaufe of the Proximity and Confanguinity between the moft Chriftian King, and the moft Serene Infanta, as foon as the fhall be full twelve years of Age, they fhall have their Nuptials and Marriage celebrated by words in prafenti, according to the Form and Solemnities prefcrib'd by the facred Canons and Conftitutions of the Catholick, Apoftolical and Roman Church. And the faid Nuptials or Marriage fhall be perform'd in the Court, Palace and Houfe of his Catholick Majefty, where his moft Serene Infanta Lady Anne has her Refidence, and that by virtue of the Power and Commiffion of the most Chriftian King; and fo foon as this is done, the most Chriftian King fhall ratify and accomplish it in Perfon, when the moft Serene Infanta Lady Anne fhall arrive in France, his Majefty joining himself with her Highnefs. And the faid Solemnity of Efpoufals fhall be perform'd either by fpecial Commiffion, or in Perfon, when the time of accomplishing the fame fhall be concerted and fettled betwixt their Majefties.

That his faid Catholick Majefty promifes and ftands oblig'd to give, and fhall give to the moft Serene Infanta Lady Anne, in Portion, and on account of her Marriage with the moft Chriftian King of France, and fhall pay to his moft Chriftian Majefty, or to one having Power and Commiffion from him, the Sum of Five Hundred Thoufand Golden Crowns, to the value of fixteen Reals a-piece, and that in the City of Paris, one day before the Celebration of the faid Marriage.

That their moft Christian Majesties fhall oblige themfelves to fecure, and fhall actually fecure the Portion or Dowry of the faid moft Serene Infanta Lady Anne, upon good and certain Rents, and upon valuable Funds and Aflignments, to the Contentnient and Satisfaction of his Catholick Majefty, or Perfons whom he fhall name for that effect; and in cafe of Diffolution of Marriage, the Portion fhall be reftor'd, and they fhall return it to the moft Serene Infanta, or to fuch as have the charge of her Highnefs and during the time that fhall elapfe, in which her Portion is not reftor'd, her Highness, or her Heirs and Succeffors, fhall receive the Revenue, which fhall be paid by virtue of the faid Affignments.

That the moft Serene Infanta Lady Anne fhall hold her felf content, and fhall be fatisfy'd with the faid Portion, without alledging hereafter any other Right fhe may have, or commencing any Action or Demand, pretending that other valuable Goods, Rights and Actions appertain, or may appertain to her, becaufe of Inheritances and larger Succeffions of their Catholick Majefties, her Father and Mother, or in confideration of their Great Perfons, in any other manner, or for any other Caufe or Title whatfoever, whether the knew it, or was ignorant of it; taking notice, that of whatever Quality and Condition the faid Actions and Things above-mention'd be, yet fhe fhall not fail to make a Renunciation of the fame in good and due Form, and with all the Affurances, Forms and Solemnities that fhall thereto be requifite and neceffary: which Renunciation fhe fhall make before fhe is marry'd, by words in præfenti.

That immediately after the Celebration of the Marriage, fhe fhall approve and ratify, conjointly with the most Christian King, with the fame Forms and Solemnities that fhe fhall have made the firft Renunciation, viz. with the fame Claufes that they fhall fee moft convenient, proper and neceffary for the Effect and Accomplishment thereof. For which Renunciation their faid Majefties fhall ftand oblig'd for the future as well as at prefent. And in cafe they do not make the faid Renunciation and Ratification, by virtue of the prefent Contract and Capitulation, yet the faid Treaties of Renunciation and Ratification are accounted, as well now as for the future, duly made, pafs'd and granted. And this fhall be done in the most authentick and effectual Form poffible, that fo they may be good and valid, together with all the derogatory Claufes, of any Laws, Jurifdictions, Cuftoms, Rights and Conftitutions to the contrary, or which may hinder in whole or in part the forefaid Renunciation and Ratification; from which their Catholick and moft Chriftian Majefties, for the above Effect and Validity, fhall derogate, and do from this prefent entirely derogate. And for the Approbation and Ratífication which they fhall make of the prefent Contract and Stipulation, they fhall and do intend and
